Terms of Service

1. Introduction

Welcome to ParkMate, a service provided by Bigger Enterprises, LLC (referred to as “we”, “our”, or “us”). By accessing or using our website located at https://www.parkmateapp.com (the “Site”), you agree to comply with and be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use our service.

2. User Responsibilities

By using ParkMate, users agree to the following:

You must be at least 18 years of age to use this service.
You are responsible for the accuracy of any information you provide, including the details of the parking spot you are posting and the bids you place.
Users posting parking spots for rent (“Listers”) must ensure that they have legal rights to rent out the spot and that it is available for the agreed duration.
Users bidding on parking spots (“Renters”) agree to pay the final bid price and any additional fees if their bid is successful.

3. Bidding Process

All bids placed on ParkMate are binding.
Bidders cannot withdraw or lower their bids once placed.
Bidding will close at the scheduled auction end time. The highest bidder at the end of the auction will be considered the winner.
In the case of disputes regarding the bidding process, ParkMate reserves the right to make the final decision.

4. Payments and Fees

Payments are processed through Stripe.
A 7% administration fee will be applied to every successful transaction between a Renter and a Lister.
All payments are final and non-refundable unless otherwise stated.

5. Dispute Resolution

Any disputes, disagreements, or claims arising out of or relating to the rental agreement are solely between the Lister (“landlord”) and the Renter (“tenant”). By using ParkMate, you acknowledge that ParkMate shall not be held liable or responsible for mediating or resolving such disputes. ParkMate is also not responsible for the quality, availability, or condition of the parking spots.

6. Liability

ParkMate is not liable for any damages to vehicles or personal property that occur while using rented parking spots.

We do not guarantee the availability or condition of any parking spot.

The accuracy of listings is the sole responsibility of the Listers. ParkMate does not verify or endorse any content posted by users.

7. Termination of Service

We reserve the right to suspend or terminate any user's account without prior notice for violations of these Terms, fraudulent activity, or any other reason we deem necessary.

8. Privacy

We collect personal information such as name, email address, and payment details. This data is used solely for providing and improving our service.

Payment details are processed securely through Stripe, and we do not store credit card information.

Your personal information will not be shared with third parties, except for necessary payment processing via Stripe.

9. Changes to the Terms

ParkMate reserves the right to modify these Terms at any time. We will notify users of significant changes, and continued use of the service after modifications indicates your acceptance of the updated Terms.

10. Off-Platform Deals and Exclusivity

Platform Exclusivity: Any arrangement that is initiated on ParkMate must be completed on ParkMate. Users agree not to engage in or arrange any side deals or payments outside of our platform.
Penalty Clause: Engaging in off-platform deals is strictly prohibited. If a Lister or Renter is found to circumvent the platform's payment system, ParkMate reserves the right to impose penalties, which may include account suspension, permanent ban, or additional fines.
